Privacy Policy

Overview

This Privacy Policy describes how Criterica Group, Inc. ("Criterica," "we," "our," or "us") collects, uses, and protects personal information when you access our websites, products, and services. Criterica Group operates offices in Palm Beach, Florida and Minneapolis, Minnesota and operates the Criterica Intelligence and Criterica Capital platforms. By using our services you agree to the practices described in this policy. Effective date: May 1, 2026.

Information We Collect

We collect information you provide directly, including your name, firm or institution name, title, and professional email address when you submit an inquiry, request investor access, or create a portal account. We do not collect payment information directly — payment processing is handled by third-party processors subject to their own privacy policies. We may also collect certain technical information automatically, including IP address, browser type and version, pages visited, referring URL, and session duration, to operate and improve our services.

Court Record Data

The Criterica Intelligence platform is built on a proprietary database of 3.52B+ real court records sourced from public judicial filings across federal circuits, state courts, and international tribunals. This database contains only public record information — names of parties, case numbers, docket entries, and outcomes — as they appear in official court filings. Criterica does not use this database to build consumer profiles or make individual credit decisions.

Model Data Use

When you submit inputs to a Criterica prediction or scoring service, those inputs and the resulting outputs may be logged and retained for a limited period for operational, security, and quality purposes, specifically to measure, monitor, and retune model performance against real outcomes. Logged prediction data is used in aggregate to validate reliability and identify drift; it is not used to train production models without a separate, explicitly negotiated data licensing agreement. For air-gapped audit engagements, portfolio inputs are used only to produce your audit and are not retained beyond the engagement. Criterica does not sell individual prediction inputs or results to third parties, and does not share individual prediction results except with service providers acting on our behalf under confidentiality obligations or where required by applicable law, court order, or regulatory process. You may request information about retention of inputs you have submitted by contacting privacy@criterica.com.

How We Use Your Information

We use information we collect to respond to your inquiries, provide and improve our platform services, send transactional communications including secure access links and portal notifications, maintain records required by applicable law, and analyze aggregate usage patterns to improve performance. We do not sell, rent, or share your personal information with third parties for their marketing purposes. We do not use your information to train our predictive models.

Cookies and Analytics

We use strictly necessary cookies to maintain authenticated sessions in the Criterica Intelligence investor portal and Capital partner portal. We use limited first-party analytics to understand aggregate traffic patterns, page performance, and feature usage. We do not use advertising cookies, cross-site tracking pixels, or third-party analytics services that build individual user profiles. You may disable cookies in your browser settings; doing so may prevent portal authentication from functioning.

Data Sharing and Disclosure

We do not sell personal information. We may share information with service providers who assist in operating our platforms — including hosting, email delivery, and authentication infrastructure — under contractual obligations that restrict further use. We may disclose information when required by applicable law, court order, or regulatory process, or to protect the rights, property, or safety of Criterica, our users, or the public. In the event of a merger, acquisition, or sale of all or substantially all assets, personal information may be transferred as part of that transaction.

Data Security

We implement appropriate technical and organizational measures to protect information against unauthorized access, disclosure, alteration, or destruction. Investor and partner portal access is protected by time-limited cryptographic tokens. All data in transit is encrypted using TLS. Sensitive data at rest is encrypted using AES-256. We conduct periodic security reviews and access audits. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce agreements. Investor portal session tokens expire after 24 hours. Inquiry records are retained for a minimum of three years to support business relationship management. You may request deletion of your personal information at any time; we will honor deletion requests subject to any legal retention obligations.

Your Rights

You have the right to access the personal information we hold about you, to correct inaccurate information, to request deletion of your information, to object to or restrict certain processing, and to receive a copy of your information in a portable format. To exercise any of these rights, contact us at privacy@criterica.com. We will acknowledge your request within five business days and respond fully within 30 days. We do not discriminate against users who exercise their privacy rights.

Children's Privacy

Our services are directed exclusively to institutional and professional audiences. We do not knowingly collect personal information from individuals under 18 years of age. If we learn that we have collected information from a minor, we will delete it promptly.

Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in our practices, legal requirements, or platform features. We will post the updated policy with a revised effective date. For material changes, we will notify registered users via email or platform notification. Continued use of our services after a policy update constitutes acceptance of the revised terms.
